MONEYME FREESTYLE CASH GIVEAWAY PROMOTION

TERMS & CONDITIONS OF ENTRY

1. These Terms & Conditions apply to the MONEYME Freestyle Cash Giveaway prize draw promoted by MONEYME Financial Group Pty Ltd ABN 40 163 691 236 of Level 3, 131 Macquarie Street, Sydney NSW 2000 (“MONEYME” or the “Promoter”) (the “Promotion”).

• We recommend that you read these Terms & Conditions in full. Information on how to enter the Promotion and information in relation to the prizes form part of these Terms & Conditions. Participation in the Promotion is deemed acceptance of these Terms & Conditions.

• The Promotion commences at 00.01 AEDT on Thursday, 11 July 2024 and ends at 23:59 AEDT on Saturday, 31 August 2024 (“Promotion Period”).

Eligibility and Entry

• Entry to the Promotion is open to permanent Australian Residents who are aged 18 years or older (“Eligible Entrants”) and who meet one of the Entry Requirements. For the purposes of these Terms & Conditions, “Australian Resident” means a person who resides in Australia at the start of the Promotion Period and who holds Australian citizenship or holds an Australian permanent residency visa. Employees of MONEYME and its related bodies corporate (as that term is defined in the Corporations Act 2001) or immediate families of employees of MONEYME are ineligible to enter. For the purposes of these Terms & Conditions, “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

• The Promotion is open to Eligible Entrants who satisfy the following requirements (“Entry Requirements”):

• an Eligible Entrant must be a current holder of a MONEYME Freestyle account; and

• an Eligible Entrant must make at least $1,000 of purchases using their MONEYME Freestyle account during a prize period set out in paragraph 9 below (each, a “Prize Period”).  Cash withdrawals and cash transfers do not qualify as purchases.

• When an Eligible Entrant, during the Promotion Period, satisfies the Entry Requirements for a Prize Period they will receive one automatic entry in the prize draw for that Prize Period only.  Eligible Entrants can receive an entry in both Prize Periods if they satisfy the Entry Requirements for each Prize Period.

Prizes

• The prizes set out in paragraph 9 below shall be drawn, in the order specified (each, a “Prize”).  In each Prize Period, there will be 1 winner of a $10,000 cash Prize and 20 winners of a $500 eGift card Prize. The $10,000 cash Prize will be the first Prize drawn in each Prize Period.

• An Eligible Entrant may only win one Prize in a Prize Period (being the first Prize drawn).

1. Prizes are non-transferrable. eGift cards are not redeemable for cash.

1. The total allocated Prize pool is a maximum of $40,000 (“Prize Pool”).

Prize Draws

1. The Prize draws will be conducted by Anisimoff Legal, an independent third party, located at G13, 3 Amy Close, Wyong NSW 2259 and will take place at 4:00pm (AEDT) on the dates set out in paragraph 9 above.

1. In the event that any Prize becomes unavailable for reasons beyond MONEYME’s control, MONEYME may at its discretion substitute the Prize for an alternative prize, subject to any written directions from a regulatory authority.

1. Should the total number of entries in the Promotion be less than the total number of Prizes available, MONEYME will retain the balance of any unallocated Prize Pool.

1. All taxes which may be payable as a consequence of receiving the Prize are the sole responsibility of the winner. Any additional expenses involved are at the Prize winner’s expense.

1. Allocation of Prizes to winners is final and binding and no correspondence will be entered into.

1. Within 2 business days after each Prize Period draw, Prize winners will be notified by email using the email address associated with their Freestyle account and the winners’ details (first name initial, surname and postcode) will be published at www.moneyme.com.au.

1. If a Prize winner cannot be contacted, or does not claim their Prize, within 14 days of the Prize draw, MONEYME will conduct an unclaimed Prize draw to distribute any unclaimed Prizes. All non-winning entries from the original draws for a Prize Period will be included in the unclaimed Prize draw for that Prize Period.  The unclaimed Prize draw for the first Prize Period (11.07.24 – 31.07.24), if needed, will be conducted by Anisimoff Legal on 26 August 2024 at 11:00am AEST.  Prize winners will be notified by 28 August 2024 by email using the email address associated with their Freestyle account and the winners’ details (first name initial, surname and postcode) will be published at www.moneyme.com.au.  The unclaimed Prize draw for the second Prize Period (01.08.24 – 31.08.24), if needed, will be conducted by Anisimoff Legal on 30 September 2024 at 11:00am AEST.  Prize winners will be notified by 2 October 2024 by email using the email address associated with their Freestyle account and the winners’ details (first name initial, surname and postcode) will be published at www.moneyme.com.au.

1. MONEYME reserves the right, at its absolute discretion, to request verification of age, identity, residential address of Prize winners and other information relevant to entry into or participation in this Promotion. MONEYME reserves the right to disqualify any individual who: (a) is involved in any way with interfering or tampering with the conduct of the Promotion; or (b) MONEYME deems has acted in a way which is contrary to the spirit of the Promotion.

Redemption of Prizes

• MONEYME will contact each $10,000 cash Prize winner to request bank details to which the funds should be transferred. Funds will be transferred by electronic funds transfer using the bank account details provided by the applicable winner within 5 business days of bank details being provided to MONEYME.

• eGift card Prizes will be sent to winners by email using the email address associated with their Freestyle account.

• Specific terms and conditions apply to eGift cards and may be viewed at https://www.prezzee.com.au/doc/terms-of-sale/.  Survey participants are responsible for ensuring that any eGift cards redeemed by them are used in accordance with the specific terms and conditions of use referred to in these Terms and Conditions including any terms and conditions in relation to the validity or expiry periods for those eGift cards.

• MONEYME is not able in any circumstances to extend the expiry date of any eGift card.  MONEYME takes no responsibility for any lost or stolen eGift cards and cannot reissue eGift cards in any circumstances. 

General

• MONEYME assumes no responsibility for any failure to receive an entry in the Promotion or for inaccurate information by any person or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then MONEYME may (where necessary with the approval of the relevant lottery authority) modify the Promotion.

• If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation. 

• Where necessary and subject to the approval of the relevant lottery authorities, MONEYME reserves the right to modify and vary these Terms & Conditions or may withdraw the Promotion at any time. MONEYME may exclude from the Promotion any entrant who breaches these Terms & Conditions or who acts in a way which is contrary to the spirit of the Promotion or these Terms & Conditions. Any decision of MONEYME is final and no further correspondence will be entered into.

• Information provided by Promotion entrants will be collected and used by MONEYME for the purposes of conducting the Promotion and for promotional purposes surrounding this Promotion. By entering the Promotion, entrants consent to the use of their information as described and agree that MONEYME may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. • To the extent permitted by law, MONEYME and its related bodies corporate, its employees, and agents shall not be liable for any claims, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss) as a result of, or arising out of, or in any way connected with this Promotion and/or the Prizes or any act or omission (whether negligent or not) of MONEYME and its related bodies corporate, employees and agents.
